These Terms of Service ("Terms") govern your use of the Birg Communications website and services. By accessing our website or engaging our services, you agree to these Terms.
Birg Communications provides software development, web design, mobile app development, UI/UX design, digital marketing, and related consulting services. The scope, timeline, and cost of specific projects are defined in individual Statements of Work (SOW) or proposals agreed upon by both parties.
Upon full payment, clients receive full ownership of all custom code, designs, and deliverables created specifically for their project. Birg Communications retains ownership of proprietary tools, frameworks, and pre-existing assets used in project delivery. We reserve the right to showcase completed work in our portfolio unless otherwise agreed in writing.
Payment schedules are outlined in individual project agreements. Standard terms are 30% upfront, 40% at project midpoint, and 30% upon delivery. Late payments may incur a 1.5% monthly fee. We reserve the right to pause work on projects with overdue balances.
Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This obligation survives the termination of any project agreement.
We warrant that our work will be performed in a professional and workmanlike manner. All deliverables include a 30-day warranty period for bug fixes. Our total liability is limited to the fees paid for the specific project in question.
Either party may terminate a project with 30 days written notice. Upon termination, the client is responsible for payment of all work completed to date. Deliverables completed and paid for will be transferred to the client.
These Terms are governed by the laws of the State of California, USA. Any disputes will be resolved through binding arbitration in San Francisco, California.
We may update these Terms from time to time. We will notify users of material changes by posting the updated Terms on our website with a new effective date.
